REGULATIONS


This Privacy Policy sets out the rules for the processing and protection of personal data provided by users in connection with their use of services offered by the Hotel Willa Odkrywców website (hereinafter: the Website)

The administrator of personal data contained on the Website is ARTUR KLUSZCZYŃSKI ARTCOM, Wrocław 52-314, Wałbrzyska 21, entered into the register of entrepreneurs under the NIP number: 8942295494 (hereinafter: ADO).

In the interests of the security of the entrusted personal data, PDA operates based on internal procedures and recommendations, in accordance with the relevant legal acts in the field of personal data protection, in particular with the Regulation of the European Parliament and of the Council (EU) 2016/679 of 27 April 2016 in on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46 EC.

PDA exercises special care to protect the interests of data subjects, and in particular ensures that personal data are:

  • processed in accordance with the law,
  • collected for specified, lawful purposes and not subjected to further processing inconsistent with these purposes,
  • factually correct and adequate in relation to the purposes for which they are processed,
  • stored in a form that allows the identification of persons to whom they relate, no longer than it is necessary to achieve the purpose of processing.

PDC performs the functions of obtaining information about users and their behavior by voluntarily entering information in forms, in order to:

  • answering users' inquiries using the contact form pursuant to art. 6 sec. 1 lit. f GDPR,
  • accepting reservations using the online reservation system pursuant to Art. 6 sec. 1 lit. b GDPR,
  • the provision of services provided by PDC pursuant to Art. 6 sec. 1 lit. b GDPR,
  • marketing, including sending commercial information to the e-mail address, if the customer has consented to it, by checking the appropriate box in the booking process pursuant to art. 6 sec. 1 lit. a GDPR. Consent to the processing of data for marketing purposes and sending commercial information may be withdrawn by clicking the appropriate link in the received message or sending such a notification to the ADO e-mail address,
  • implementation of the legitimate interest of ADO in special cases pursuant to Art. 6 sec. 1 lit. f GDPR, e.g. debt collection,

Upon the first visit to the Hotel Willa Odkrywców Website, the user is notified of the use of cookies. By staying on the website, the user accepts the use of cookies on the website. If you do not change your browser settings, you consent to the use of "cookies".

The cookie settings will be changed after restarting or refreshing the session on the ADO website.

The installation of "cookies necessary for the basic functionality of the Website" is necessary for the proper operation of the website, in particular required for authorization.

Cookies necessary for the website to function can be changed by changing the browser settings, however, it should be borne in mind that changing the settings may cause the website to malfunction.

Users who, after reading the information available on the Website, do not want cookies to remain in the device's web browser, should delete them from their browser after completing their visit to the Website. The Website uses the following types of cookies:

In terms of the functionality of each cookie, they can be divided into:

  • analytical files that help to improve the comfort of using the website by understanding how users use and convert on it,
  • marketing files, used to personalize the content of advertisements, properly target and analyze the performance of marketing and sales channels,
  • necessary files, i.e. fundamental for the basic functionality of the Website.

PDA may use automated decision making, including profiling, for marketing purposes (including automated matching of advertisements to your interests and measuring their effectiveness), and adjusting the offer pursuant to art. 6 sec. 1 lit. a GDPR.

The recipients of personal data may be bodies, institutions and entities authorized under the law, as well as entities providing services to ADO (e.g. legal, IT, marketing, accounting services and other entities involved in the implementation of the ordered service.

The data processed by PDC may be viewed by the Website user who provided it. The user also has the right to modify this data, request its deletion and limit or stop processing its personal data at any time. At any time, the user may also request removal of his personal data from the website. The right to data portability does not apply as no standard has been established for the exchange of such data between hotel establishments.

The Website User has the right to withdraw consent at any time without affecting the lawfulness of processing based on consent before its withdrawal, by direct contact with PDC or, in the case of technology, by changing cookie settings.

Each user of the Website may lodge a complaint with the Office for Personal Data Protection.

The Website may contain links to other websites that operate independently of the Website and are not supervised by the Website in any way. These websites may have their own privacy policies and regulations, which we recommend that you read carefully.

ADO reserves the right to change the privacy policy of the website, which may be caused by the development of internet technology, possible changes to the law in the field of personal data protection, and the development of the Website. We will inform users about any changes in a visible and understandable way.


Bearing in mind the content of the Act of 28 July 2023 amending the Act - Family and Guardianship Code and certain other acts, including the Act of 13 May 2016. on counteracting the threat of sexual offences and the protection of minors and the resulting obligation to introduce standards for the protection of minors by hotel and tourism service providers, the Willa Odkrywców Hotel in Szklarska Poręba (hereinafter: the ‘Hotel’) adopts this document as a model for standards, policies and procedures in the event of a suspicion of harm to a child staying at the Hotel and the prevention of such threats.

We will implement the policy for the protection of minors in our hotel through this policy:

I. General principles

1. The Hotel Manager is responsible for training subordinate employees in the protection of minors on the premises of the Hotel.

2. Each employee is obliged to undergo training in the field of protection of minors described in this document, which is confirmed by a statement of familiarisation with this policy. A specimen of the declaration is attached as Annex No. 4.

3. The Hotel shall conduct its operations with the utmost respect for human rights, in particular the rights of children as vulnerable persons.

4. The Hotel recognises its role in conducting a socially responsible business and promoting desirable social attitudes.

5. The Hotel particularly emphasises the importance of the legal and social obligation to notify law enforcement authorities whenever a crime is suspected to have been committed against children and undertakes to train its staff in this regard.

6. The Hotel undertakes to educate its staff on circumstances indicating that a child on the premises may be abused and on how to respond promptly and appropriately to such situations.

7. One of the forms of effective child abuse prevention is the identification of the child staying in the facility and their relationship to the adult with whom they are staying in the facility. Staff shall take all possible steps to carry out the identification of the child and their relationship to the adult with whom they are in the facility.

II. Description of the procedure to be followed at the time of check-in for guests travelling with minors

1. Each time an adult travelling with minors performs check-in operations at the Hotel reception, he/she is required to make a statement to identify the child and his/her relationship to the person with whom he/she is staying in the facility on a form issued by the reception employee. A model form is attached as Appendix 3.

2. Each Hotel employee is required to pay particular attention to the relationship between the minor and the person with whom he/she is staying at the Hotel, including paying particular attention to the child's behaviour towards the accompanying adult, the child's appearance, the child's behaviour e.g. restless, upset and avoiding eye contact, and the behaviour of the adult towards the child.

3. If the adult travelling with the child refuses to make a statement as described in paragraph 1 above, and if there are reasonable doubts about the safety of the child, it is imperative that the ‘suspected child abuse procedure’ described below is initiated.

III. Description of the procedure in the event of suspected child abuse

1. Whenever possible, identification of the child and his/her relationship with the adult with whom he/she is staying at the Hotel shall be made.

2. In unusual and/or suspicious situations at the Hotel reception indicating a possible risk of child abuse, detailed identification is mandatory to be carried out by a member of the reception staff. Examples of situations likely to raise suspicion are given in Annex 1.

3. To make a detailed identification of the child and his/her relationship to the person with whom he/she is staying in the facility, it is necessary to:

  • ask for the child's identity and the child's relationship to the person with whom they have arrived at or are staying at the facility. To do this, you may ask for the child's identity document or other document that proves that an adult has the right to care for the child in the facility. A list of sample documents is indicated in the footnote below. In the absence of an identity document, you can ask for the child's details (name, address, PESEL number);
  • in the absence of documents indicating the relationship between the child and the adult, the adult and the child should be asked about this relationship. See Appendix 2 for an example of an adult and child interview schedule;
  • if the adult is not the child's parent or legal guardian, ask if they have a document showing parental consent for the adult to travel with the child (e.g. a written statement);
  • if the adult does not have a parental consent document, ask for the phone number of the above to call and confirm the child is staying at the facility with the stranger adult with the knowledge and consent of the parents/legal guardians.

4. If there is resistance from the adult to show the child's document and/or indicate the relationship, explain that the procedure is to ensure the safety of the children using the Hotel.

5. Once the matter has been resolved in a positive manner, thank the person for their time in making sure the child is well looked after and reiterate that the procedure is to ensure the safety of children.

6. If the conversation does not clear up any doubts about the suspicion against the adult and their intention to harm the child, the immediate supervisor should be notified.

7. From the point at which the first doubt arises, both the child and the adult should be under constant observation by staff and not left alone.

8. The supervisor who has been alerted to the situation will decide whether to notify the police or, if in doubt, take over the conversation with the suspect adult for further clarification.

9. If the conversation confirms the belief that a child has been attempted or committed, the supervisor shall report the suspicion to the police. In such a case, the provisions of Section IV of the procedure shall continue to apply.

10. If unusual and/or suspicious situations are witnessed by employees of other departments of the Hotel, e.g. cleaning service, room service, restaurant staff, they should immediately notify the immediate supervisor who will decide on appropriate action to be taken or, in his/her absence, immediately notify the reception staff.

11. Depending on the situation and location, the supervisor verifies the extent to which the suspicion of child abuse is justified. To this end, he/she selects the appropriate measures leading to the clarification of the situation or decides to intervene and notifies the police.

IV. Description of how to deal with circumstances indicating harm to the child

1. If you have a reasonable suspicion that a child in the facility is being abused, you should immediately notify the police by calling 112 and describing the circumstances of the incident. Depending on the dynamics of the situation and circumstances, the call is made by the person who directly witnesses the incident (employee/supervisor). If the notifier is an employee, he/she shall simultaneously inform his/her supervisor of the incident.

2. Reasonable suspicion of child abuse occurs when:

  • the child has disclosed the fact of abuse to a member of staff at the facility,
  • the worker has observed the abuse,
  • the child shows signs of abuse (e.g. scratches, bruises) and when questioned responds incoherently and/or chaotically and/or becomes embarrassed or there are other circumstances which may indicate abuse e.g. child pornography found in an adult's room.

3. In this situation, all possible steps should be taken to prevent the child and the suspected child abuser from leaving the premises.

4. Where appropriate, a citizen's arrest of the suspected person may be made. In such a situation, the person should be kept under the supervision of two members of staff in a separate room away from the view of other visitors until the police arrive.

5. In all cases, the safety of the child must be ensured. The child should be in the care of a member of staff until the police arrive.

6. In the case of a reasonable suspicion that a crime has been committed involving contact of the child with the perpetrator's biological material (sperm, saliva, epidermis), the child should, if possible, be prevented from washing and eating/drinking until the police arrive.

7. After the child has been collected by the police, the CCTV footage and other relevant evidence (e.g. documents) concerning the incident should be secured and a copy given to the public prosecutor or police upon request.

8. After the intervention, describe the incident in an incident log or other document designed for this purpose.

V. Rules to ensure safe relations between minors and hotel staff

1. Staff Relationship with Children: You are required to maintain a professional relationship with children and each time consider whether your response, message, or action towards a child is appropriate to the situation, safe, reasonable and fair. Act in a way that is open and transparent to others to minimise the risk of misinterpretation of your behaviour.

2. Communicate and cooperate with children:

  • be patient and respectful in your communication with children;
  • listen carefully to children and give them answers appropriate to their age and the situation at hand;
  • you must not embarrass, humiliate, belittle or insult a child or shout at a child;
  • you must not disclose sensitive information about the child to unauthorised persons, including other children;
  • respect your child's right to privacy;
  • you must not behave in an inappropriate manner in the presence of children;
  • you must not enter into any romantic or sexual relationship with the child or make propositions of an inappropriate nature;
  • you must not record your child's image (filming, voice recording, photographing) for private use;
  • you must not offer your children alcohol, tobacco products or illegal substances, or use them in the presence of your children.

VI. Recruiting people to work with children

1. All persons working with Children must be safe for them, which means, among other things, that their employment history should indicate that they have not harmed any child in the past.

2. It is mandatory for staff employed by the Hotel to be checked against the Sex Offender Register for work related to the education, leisure and care of Children. A person's check on the Sex Offender Register is done by printing out the results of a search of the person on the Sex Offender Register with restricted access, which is then attached to the personal file of the person checked. The check must be repeated annually.

3. All staff employed to work with children, including those who may have potential contact with children should declare that they have no criminal record and that there are no proceedings for acts against children.

VII. Glossary

For the purposes of this document, the meaning of the following terms has been clarified:

  1. A child is any person under the age of 18.
  2. A stranger adult is any person over the age of 18 who is not the child's parent or legal guardian.
  3. Harming a child means committing an offence against a child.
  4. Offence against a child - all offences that can be committed against adults can be committed against children, in addition to offences that can only be committed against children (e.g. sexual abuse under Article 200 of the Criminal Code ). Due to the specific nature of tourist facilities, where seclusion can easily be obtained, the offences most likely to occur on their premises will be offences against sexual freedom and morality, in particular rape (Art. 197 of the Penal Code), sexual exploitation of insanity and helplessness (art. 198 of the Penal Code), sexual exploitation of dependence or critical position (art. 199 of the Penal Code), sexual exploitation of a person under 15 years of age (art. 200 of the Penal Code), grooming (seduction of a minor by means of remote communication - art. 200a of the Penal Code).

VIII. Final provisions

1. The policy shall come into force on 15.08 2024.

2. The hotel makes the policy for the protection of minors available at reception.
